§2. Purposes, Legal Basis, and Scope of Data Processing

1. In connection with the use of the Website and participation in counseling/psychotherapy, it is necessary to process personal data and special category/sensitive data (first and last name, email address, phone number, therapist’s session notes, and the fact that an appointment was booked).

2. Purposes and legal basis for processing:

   • Scheduling and Providing Psychotherapy Services: Conducting consultations and psychotherapy sessions, scheduling appointments and documenting completed visits, and maintaining ongoing contact with the patient. The legal basis is Article 6(1)(b) of the GDPR (necessary for the performance of a service) and Article 9(2)(a) of the GDPR (Explicit consent to the processing of health-related data).

   • Compliance with legal and tax obligations: Issuing invoices or receipts and maintaining accounting records. The legal basis is Article 6(1)(c) of the GDPR in conjunction with tax law provisions.

   • The Controller’s legitimate interest: Asserting claims or defending against claims arising from its business activities (Article 6(1)(f) of the GDPR).

3. Providing this information is voluntary, but it is necessary to make a reservation and to conduct a consultation or psychotherapy session.

§3. Recipients of Personal Data

Your personal data may be disclosed only to entities that support the provision of the service:

• The psychologist or psychotherapist conducting your consultation or psychotherapy.

• To an external accounting firm (to the extent necessary to issue an invoice or bill).

• Technology and hosting service providers (e.g., Zenbox sp. z o.o., the Bookly reservation system).

• To the relevant public authorities upon their request, in accordance with the applicable laws.

§4. Data Retention Period

1. Data processed for the purposes of scheduling appointments and providing psychotherapy services is retained for the duration of the consultation or psychotherapy.

2. After the service has been completed, the data may be retained for the period required by tax and accounting laws (5 years from the end of the tax year) and for the statute of limitations period for any civil claims (6 to 10 years).

3. Data collected for technical and statistical purposes (cookies) is stored for the period specified in the cookie settings or until the User deletes them.

§5. Patient/User Rights

With regard to the processing of personal data, you have the following rights:

• The right to access your data and receive a copy of it;

• The right to rectify (correct) data;

• The right to erasure (“the right to be forgotten”)—in the cases specified in the GDPR;

• The right to restrict data processing;

• The right to withdraw consent at any time (without affecting the lawfulness of processing carried out on the basis of consent prior to its withdrawal);

• The right to file a complaint with the supervisory authority—the President of the Office for Personal Data Protection (2 Stawki St., 00-193 Warsaw).
